AFL suspends payments to Essendon over Hird 'pay'

THE AFL has suspended its regular payments to Essendon until the club clarifies whether it is paying banned coach James Hird.


The League will withhold the monthly payments after writing to the Bombers last week and again on Monday concerning the pay situation around Hird.


It said in a statement on Thursday that there was "a clear intention" when Hird was penalised in August over Essendon's supplements program that he could not be paid by the Bombers or work in any way for the club.


"Since September, the AFL has been in consultation with the Essendon FC concerning the terms of James Hird's suspension, including the fact he cannot be paid by the club for a period of 12 months," chief executive Andrew Demetriou said in the statement.

The club has also been notified if it "continues not to comply" with the terms of the suspension then it will have to appear before the AFL Commission in Melbourne next week.


The club is yet to reply to the AFL's letter and until it does will not receive money from head office.


Demetriou recently strongly denied Hird was being paid by the Bombers or AFL, but since then Tania Hird has claimed her husband is still being paid as part of the accepted sanction.

On Wednesday, she told News Corp that her husband agreed to a sanction with pay in lieu of taking the AFL to court.

"Of course he's being paid, that was the deal," Mrs Hird said.

"Andrew Demetriou knew it, the AFL knew it."

Mrs Hird also accused the AFL of "threatening" her husband and the Bombers and wanted the governing body to "stop distorting the truth".


Demetriou said he thought the pay situation had been resolved when he said recently that Hird was not being remunerated.


"The public statements from the AFL, from myself as CEO over the last week, were in the belief that Essendon had concluded its payment arrangements and begun the suspension period. The AFL has since sought confirmation and is yet to receive it," he said.

Hird's punishment was part of the club's penalties, which included a $2 million fine and being banned from this year's finals, for its controversial 2012 supplements program.

The AFL's total distribution of funds to Essendon in 2012 was $11.98 million.

Time for the big fat bloke on the big fat wage who runs the AFL to give up and stop trying to cover his big fat butt.
Well done to Tania Hird for speaking out and to say what we all think.
If this latest threat comes through I can see a huge law suit coming the AFL's way. Watch out Andrew !

Agree, i think that day in court is not too far away. I'd almost prefer it now.

Just when you thought Demetriou couldn't get any stupider... Somehow I don't think a 'clear intention' gives him much of a legal precedent :)

The SuperCoach leaks have started! Al Patton from the Herald Sun has just dropped some gold, officially stating that Gold Coast mini draft star Jack Martin will set you back $222,300 in SuperCoach next year. Is he worth it?
It's off the back of rumours that SuperCoach will have a new pricing system in 2014, including a bigger salary cap.

As can be seen from other leagues overseas, club licences can be suspended or revoked to play in a particular competition by those running the comp. The AFL probably has that discretion here. Essendon would be wise not to push too hard at this stage. We saw last year they had little support from the other clubs when key decisions were made.

I'm pretty sure the AFL have the ultimate arse covering clause in their charter. Each Club is made to sign, and adhere to the charter to keep their "license" to be an AFL Club. Basically the clause/rule in layman's terms means "We, the AFL, can do what we like, when we like, if we consider it the best thing to do". I was on a competition cricket committee 20 years ago, and we introduced this rule, and most competitions now have it in their constitutions. Of course it is worded more in legal terms than that.
If Essendon take the AFL to court over this, this is the rule they will have to fight. Given they accepted the rule when they signed the AFL agreement, they will have a hard time winning any case that challenges it. Their only chance would be to show that the AFL have grossly over-stepped the intention of the rule, and I don't think that is the case here, even though what they (the AFL) are doing is unfair and petulant.

This this this. I know there was a supposed verbal agreement made regarding Hird's pay but surely those involved would've known there would've been a massive backlash. I know technically, legally, whatever that Hird feels an entitlement to his pay and I guess the average joe would just want what was agreed upon but surely we'd have been better trying to clean the slate as best we could.

It was nice being out of the headlines for a while.... :(

Absolutely agree here Rowsus. Would be nice to get to the truth however.
Not something that happens often in the hi flying corporate world though.

Both Hird/Essendon & the AFL are way past truth and both are using spin doctors, so you will never find the truth out. I'd give Hird/Essendon's spin doctors the decision on points so far. The problem that Demetriou is always going to have, as a mate mentioned to me last night, is no one barracks for the AFL.
